Terms And Conditions

The following terms and conditions apply to all companies and or persons or other entities (“you” or “I”) that are attending any workshop organized by or at The Painted Pallet, LLC. Please ensure you have read and understand the following:

Registration
Project selection and customization information for your project is required at the time of booking on our registration form.  Please be sure to double check your spelling and information to ensure your project stencil and materials will be ready for you at the start of class. Painted Pallet will not be held responsible for any text or other errors you make during registration.

Promotional materials and materials at the Workshop
You agree that we may include your details in any promotional materials relating to The Painted Pallet workshop and/or any materials used at the workshop. We are not liable for errors or omissions contained in such information.

Unless otherwise stated, the copyright for any such promotional materials and any materials used at The Painted Pallet Workshops (including information acquired during a Painted Pallet workshop) belongs to us and may not be reproduced in any medium without our prior written consent.

You may use such materials for your own private purposes only and may not reproduce, publish or deal with such materials in any way for any commercial use.

We reserve the right to change the published program (including workshop scheduling) or materials as we think fit.

Workshop Cancellation Policy
Due to the custom nature of our studio, registration fees are non-refundable.  Registration cancellations made at least 72 hours in advance of a workshop will be granted a class credit for a future workshop. 

Our sole liability in relation to any cancellation, postponement or change of venue shall be limited to the price paid by you for such workshop and we shall not be liable under any circumstances for any consequential losses.

Due to staffing, we reserve the right to cancel workshops if attendance is below 3 attendees.

Private Party Cancellation Policy
A deposit is due when booking your private party and will go towards your party’s total due balance.  If you are unable to meet the minimum required, the deposit will be forfeited.  If you choose to cancel your private party less than two weeks in advance, the deposit will not be refunded due to the nature of our studio and the demand for private party times on our calendar.

For private parties, we require all attendees to register and provide complete customization information for their project at least 72 hours in advance so we can prepare the materials for your party.

Project Change Request
If you would like to make changes to your project within 72 hours of your workshop, we would be happy to accommodate your request for a $10 stencil recut fee, payable upon the start of your workshop. Changes made prior to 72 hours are done free of charge.

Age Restriction
Due to the tools & stains used infants and children under the age of 14 are not permitted during our regular workshops. If a participant brings an infant or child, they will be asked to rebook for a different workshop when they can attend ‘child’ free and enjoy the experience fully.

Children under the age of 14 are welcome to attend our children’s workshops or camps or other family classes we offer.

Travel, accommodations
If you are late to the workshop or prevented from attending due to travel delays or any other circumstances, we shall not be obliged to provide you with a refund or to wait to start the workshop until you arrive.

Photography and filming
We may wish to photograph or film our workshops and reserve the right to do so for the purposes of promoting The Painted Pallet or otherwise. You consent to us (or any other person attending the workshop) photographing or filming you and any persons attending the workshop with you. You may photograph or video the workshop for private use only.

Safety Waiver
I understand that I will use and/or be exposed to drills, hammers, mallets, nails, sand paper, paint and oil based stains during Painted Pallet workshops.  I agree to be responsible for any damages to Painted Pallet’s tools, equipment or facilities, to the extent and in the percentage I cause such damages.

If I act in any way that in the opinion of The Painted Pallet staff is likely to cause any harm or nuisance to any person at the workshop, I will be required to leave the facility and The Painted Pallet will not be liable to refund my registration fee or any other payment.

I recognize there may be certain inherent risks in participating in Painted Pallet workshops.  I agree to take precautions and observe all Painted Pallet policies, recommendations, directions, rules and warnings; whether provided orally or in writing. I assume full responsibility for personal injury to myself.

I further agree to release and discharge The Painted Pallet, LLC for any injury, loss or damage that may arise out of my participation in Painted Pallet workshops or my presence in The Painted Pallet, LLC or Spirited Art Auburn, LLC facilities whether caused by me, Painted Pallet or any third party.

I agree to indemnify and defend The Painted Pallet, LLC against all claims, causes of action, damages, judgments costs or expenses including reasonable attorney’s fees and other litigation costs which may in any way arise from my participation in Painted Pallet workshops or my presence in The Painted Pallet, LLC or Spirited Art Auburn, LLC facilities.

I HAVE READ THE PAINTED PALLET POLICIES AND THIS SAFETY WAIVER AND UNDERSTAND THEM.  I FURTHER UNDERSTAND THAT BY CHECKING THE “ACCEPT POLICIES” BOX, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS THAT I MIGHT OTHERWISE HAVE.
